My STBX and his never ending health complaints

I could write pages about this topic, but I will spare you all what many of you are also experiencing...

My STBX is claiming that he can't work, because of his health (big fat lie, he's not working because he doesn't want to).

Apparently, he's getting some medical documentation to support such a claim.  I can't wait to see it.

Any advice on how to handle medical complaints during the divorce?  I'm documenting when he does work and what I know he does physically, other than that what else can I do?

We had sort of the opposite situation, where my H's ex tried to argue that he could earn way more money than he does.

I think this is a situation where you need to talk to a lawyer about the specifics of what you're going to have to prove and what a judge is likely to order.

Showing that he can and does work is helpful. Documenting the amount of work he did until you filed for divorce - also probably helpful. Is he on disability? If no, then why is he saying he can't work in the context of divorce but not pursuing disability (I know it's not black and white like that but that argument might get traction.)

In my state you can use his earning capacity to determine child support. To prevent situations exactly like this. I guess it's a question of, can you prove he has the capacity to earn more?
